Jair Bolsonaro has been detained after authorities concluded he posed a definite escape threat while under domestic detention.
The one-time leader was sentenced of planning a military coup in September and given more than a 27-year term in incarceration, but he continued under home detention pending court reviews.
High Court Judge Justice Moraes said the action to imprison the septuagenarian politician was a preventative measure after fresh information came to light.
This included attempting to break his electronic bracelet and a invitation to a public vigil that could enable a potential flight.
Court Filing Details Escape Concerns
In a paperwork permitting the custody, the judge said data from the unit overseeing the former president's confinement suggested the ex-president's plan to remove the tracking monitor to secure accomplishment in his getaway".
This, it said, would be assisted by the disorder caused by the demonstration called by his child.
His son, Flávio, who serves as a senator, called for a meeting of his backers near his father's house to take place on Saturday evening.
His son wrote on digital networks on Friday: Do you plan to struggle for your nation, or watch it all from your phone there on your settee? I call on you to battle with us."
He said the gathering would be so followers could seek divine intervention for his health and for the reestablishment of democratic governance in our nation."
Embassy Asylum Concerns
Part of the magistrate's ruling was the possibility of the former president's transfer to embassies near the home, considering that the inquiries revealed a background of arranging to request asylum through a diplomatic representation", a declaration said.
The court filing highlights that the US embassy in the capital, the capital city, is positioned around approximately 13 kilometers from the former president's residence.
Worldwide Consequences
His judicial problems have provoked anger from fellow conservative nationalist US President President Trump, prompting him to enact a 50% tariff on goods coming from Brazil.
The former president is being detained in a federal law enforcement building in Brazil's capital city and will have a detention review on the following day.
Latest Court Petitions
It was only on Friday that the former president's lawyers asked the High Court to permit him to serve his whole jail sentence under domestic detention, with tracking devices.
They also asked that the former president be allowed to depart his residence for healthcare, saying he demanded ongoing care for respiratory ailments and other health problems.
Background on Conviction
Bolsonaro was convicted of leading a scheme aimed at retaining his authority after he failed to win the 2022 election to his political opponent, Lula.
Top judicial officials said that he knew of a scheme which involved plans to kill Lula and his running partner, Alckmin, and to imprison and murder Justice Moraes - the Supreme Court justice who has been presiding over Bolsonaro's trial.
The scheme was prevented because it didn't receive the support of the armed forces officials. The current president was inaugurated without issue on the first day of 2023.
But a following week, on the eighth of January, thousands of Bolsonaro supporters invaded and destroyed official structures in the national capital, Brazil's capital.
The police took action and around 1,500 people were taken into custody.
The magistrates found that the protesters had been provoked by Bolsonaro whose plan, they said, was for the Brazilian military to take action, bring back stability and return him to office.
At the moment, the legal team called the over 27-year sentence "absurdly excessive.
He was also prohibited from campaigning for office until the year 2060 - a decade minus two years after the conclusion of his imprisonment.
The ex-leader called the legal proceedings a "witch hunt and said it was intended to stop him competing in the 2026 presidential election.
